The Court of Appeal’s recent decision in Cardona -v- Rooney (9th February) brought to mind a `ticklish` issue concerning section 27(2)(b) of the Trustee Act 1925 – does it apply to distributions of personalty?  Should trustees/personal representa­tives perform bankruptcy searches before distributing?
