The talk will consider the effects of some recent cases and recommendations for best practice by working through a case study from the perspective of a professional trustee faced with documentation issues. The talk will consider potential pitfalls including avoiding losing claims through limitation, when advisors can provide necessary advice (and when they can’t), and how trustees can increase the chances of recovering assets through claims. Philip and Stephen will go on to consider some recommendations for scheme compliance, how to take appropriate advice to protect the trustees’ position, and ensuring that trustees have taken the steps they need to under the regime of the new Code of Practice.

Helena and Chris are disputes lawyers in the tier 1 pensions litigation practice, who specialise in all types of claims arising from a pension scheme, including bringing and defending claims for professional negligence  against legal, actuarial and investment advisors and dealing with funding and moral hazard disputes. Philip and Stephen are partners in the newly promoted tier two advisory practice of the pensions group. They provide all types of pensions advice, particularly to trustees and employers of larger schemes.  Both were recently highlighted in the recent Legal 500 directory for their practical, commercial advice.
